Acceptance of these terms

These terms and conditions ("Terms") govern your use of the website at aricsoftware.com and our text messaging program, both operated by Aric Software & Design, Inc ("Aric", "we", "us") of Macon, Georgia. By using the website or opting in to text messages, you agree to these Terms. If you do not agree, do not use the website or the messaging program.

Our services and customer agreements

Aric provides software platforms and services to government customers, including the Aric Assessment Portal, our fleet operations platform, and the Aric Communication Service. Access to those platforms is governed by the written agreement between Aric and the government customer, such as a master services agreement or signed order form. If these Terms conflict with a customer agreement, the customer agreement controls for that customer and its users. These Terms govern the public website and the messaging program described below.

Text messaging program terms

Aric sends transactional text messages to users who opt in: assessment status updates, report availability notices, task and check reminders, and fleet maintenance and operations alerts. No marketing or promotional messages are sent.

• Consent. You receive messages only after entering your mobile number and checking an explicit consent statement on an authenticated page of one of our platforms. Consent is not a condition of using our services. You represent that the mobile number you provide is your own.
• Opt-out and help. Reply STOP to any message to cancel, or remove your consent on the page where you opted in. Reply HELP for help, or contact us at info@aricsoftware.com.
• Frequency and rates. Message frequency varies based on account activity. Message and data rates may apply according to your mobile plan.
• Carriers. The program is available on major United States carriers. Carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission by your carrier and is not guaranteed.
• Privacy. Our handling of your mobile number and consent records is described in our Privacy Policy. No mobile information is shared with third parties or affiliates for marketing or promotional purposes.

Permitted use of the website

You may use the website for lawful purposes only. You agree not to interfere with its operation, attempt to gain unauthorized access to any system or data, scrape or harvest content or contact information, or misrepresent your identity or affiliation when contacting us.

Intellectual property

The website and its content, including text, graphics, logos, and software, are the property of Aric Software & Design, Inc or its licensors and are protected by copyright and trademark law. You may view and print pages for your own evaluation of our services; any other reproduction or use requires our written permission.

Disclaimers

The website and the messaging program are provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. Website content is for general information about our services and is not legal, security, or compliance advice for your organization. Warranties applicable to our platforms, where offered, are stated in the customer agreement.

Limitation of liability

To the fullest extent permitted by law, Aric is not liable for indirect, incidental, special, or consequential damages arising from use of the website or the messaging program, including damages caused by delayed or undelivered messages. Nothing in these Terms limits liability that cannot be limited under applicable law, and nothing here reduces the obligations Aric accepts in a signed customer agreement.

Governing law

These Terms are governed by the laws of the State of Georgia, without regard to its conflict of laws rules. Any dispute arising under these Terms will be brought in the state or federal courts located in Bibb County, Georgia, except where a customer agreement or applicable law provides otherwise for a government customer.

Changes to these terms

We may update these Terms from time to time. Changes are posted on this page with a new effective date, and continued use of the website or the messaging program after a change takes effect constitutes acceptance of the updated Terms.
